Discutir con los amigos es fácil. Es más difícil discutir con quien no comparte nuestros valores íntimos y preciados, con quien ofende nuestras creencias, deshonra nuestra fe y esperanza o se ríe de nuestras opiniones. ¿Cómo se ha de actuar en estos casos? ¿Con la espada y la ira en la mano, la indiferencia y el silencio, o el argumento y la palabra? ¿Y si no se puede ya razonar? ¿Cuando uno topa con el límite insalvable de la impotencia de (...) la razón se ha de acudir entonces a la potencia de la brutalidad? ¿Se puede, en breve, discutir con el “enemigo”? Este trabajo es un intento teoréticofilosófico por pensar analíticamente, modos de responder a estos interrogantes. Se busca examinar los límites, posibilidades y confines de la libertad de expresión, vista desde una teoría realista de la argumentación y de la pragmática del discurso normativo. Como ejemplos explicativos se toman conflictos generados por los grupos radicales, las sectas religiosas, los movimientos sociales violentos, entre otros. (shrink)

As more young people feel safe to outwardly identify as transgender or gender expansive (TGE), meaning that their gender identity does not align with the sex they were assigned at birth, an increasing number of youth who identify as TGE seek gender-affirming medical care (GAMC). GAMC raises a number of ethical questions, such as the capacity of a minor to assent or consent, the role of parents or legal guardians in decisions about treatment, and implications for equitable access to (...) care when differing parental or custodial viewpoints are present. These questions are further complicated by the difficulties in explaining the limits of long-term research in GAMC, with regard to the preservation of fertility, for example. We present two de-identified composite case studies to highlight dilemmas that may arise and offer recommendations to better support patient- and family-centered decision making for GAMC. These include employing a multidisciplinUniverary shared decision-making approach, disentangling informed consent and assent from chronological age, developing a consistent approach to the assessment of decisional capacity, and developing age-appropriate informational materials. In this paper the authors deal with the story of Saman Abbas, an 18-year-old girl of Pakistani origin, who disappeared in Italy and was killed by her family after she refused an arranged marriage. The case raised a public debate between right-wing parties, who accused the left-wing parties of being culpably blind to the danger of Islam and too tolerant towards illiberal cultures, and left-wing politicians who responded equating Saman’s murder with the domestic killing of Italian women. We argue that (...) neither position does justice to Saman’s story. We hold that Saman’s case is an example of intersectional oppression where gender oppression is intertwined with the immigrant’s oppression in a Western democracy. Thus, we counter the dilemma posed by Susan Okin, namely that there is an inherent conflict between the rights of minority cultures and the rights of women. In order to rebut Okin’s position, we rehearse multicultural positions concerning the protection of minority cultures, on the one side, and feminist positions regarding the promotion of autonomous choice, on the other. Our conclusion is that (a) multiculturalism cannot be identified with cultural rights, and (b) that what are autonomous choices and what are, instead, adaptive is difficult to ascertain and, especially, difficult to apply in politics. Structural oppression is instead the key normative notion for addressing equality among genders and among citizens at large. The intersectional oppression suffered by women like Saman cannot be addressed by a restriction of toleration for immigrant cultures or simply by security measures. To prevent more cases like Saman’s in the future, the immigrant oppression should be taken seriously as well. In the context of fairer terms of inclusion, conditions of reciprocal trust between minority and majority may develop and the deconstruction of the patriarchal view of family can start. (shrink)

Neste ensaio, advoga-se a necessidade de se repensar as questões curriculares a partir da teoria da complexidade, justificando a importância desse instrumento para evitar a visão positivista de currículo, que separa disciplinas, fragmenta objeto do conhecimento, a realidade e a vida. Para tanto, são trabalhados os conceitos de currículo e de complexidade, reconhecida em seus aspectos ontológico, epistemológico e metodológico, bem como a importância da relação currículo/complexidade e alguns de seus possíveis desdobramentos em educação. Observa-se que a teorização complexa do (...) currículo ajuda a repensá-lo a partir da pluralidade cultural, da unidade na diversidade, da capacidade de produzir coisas novas no processo a partir de processos emergentes. Para tanto, considera-se a intersubjetividade e multirreferencialidade, reafirma-se a importância da alteridade, da luta pela afirmação das diferenças, bem como dos processos auto-eco-organizadores resultantes dos diálogos ocorrentes em sala de aula. O conhecimento interdisciplinar ou transdisciplinar decorrentes desta relação, em seus papéis formativo e elucidativo, são fundamentais ao mobilizar os processos de interdependência, de mestiçagem, de interfecundação e de religação de saberes. Assim compreendido, o currículo transforma-se no espaço da solidariedade epistêmica, da emergência e mudança de valores, diante da multiplicidade e heterogeneidade das experiências que requerem a superação da fragmentação disciplinar e a presença do diálogo constante. Ao finalizar, a autora ressalta a importância de se desenvolver, através das práticas curriculares, a reforma do pensamento proposta por Edgar Morin, a partir da inteligência da complexidade, como condição fundamental para superação da fragmentação do conhecimento e o encontro de soluções compatíveis à magnitude dos problemas atualmente emergentes. The current times call for reforms in educational processes. The Covid-19 pandemic had an unforeseen impact on the educational system in all countries. This need for change requires new pedagogies and new methods for teaching and learning. Understanding the need for change is essential for the formulation of adaptive proposals, as well as for the generation of training activities to complement the teaching curriculum. New educational practices lead to a vision of educational quality, with new approaches that allow the continuous (...) integration of knowledge and permanent interaction with the student. Resumo: O aumento significativo de discursos de ódio e a violência contra minorias sociais revela a sala de aula como microcosmo de uma sociedade estruturada por políticas de violência colonial e patriarcal. Experiências de sala de aula evidenciam contradições que variam em torno de práticas de libertação e/ou dominação de corpos e mentes. O ensaio propõe uma discussão sobre as políticas de dominação e o processo pedagógico na perspectiva da intelectual, ativista social e crítica cultural bell hooks. This essay discusses the politics of domination and the pedagogical process from the perspective of the intellectual, social activist, and cultural critic bell hooks. Her conception of education derives from her experience of class, race, and gender oppression, culminating in her ethical-political education project. We start from the perspective that the experience of the body in the classroom can be a privileged locus for critical reflections on interconnected systems of oppression. Previous evidence has shown that excessive valuing happiness may relate to lower psychological wellbeing across cultures. Considering the lack of data with Spanish population, we examined the relation between tightly holding happiness emotion goals and subjective wellbeing in a sample of Spanish women, and explored the mediation role exerted by psychological inflexibility components in the relation between valuing happiness and subjective wellbeing. A female adult sample filled out measures of excessive valuing happiness, psychological inflexibility, positive affect, negative affect, and life (...) satisfaction. Valuing happiness only showed positive total effects on negative affect and strong direct effects on both cognitive fusion and experiential avoidance. Analyses revealed the mediating roles exerted by psychological inflexibility components, with experiential avoidance leading to lower pleasure; and cognitive fusion leading to greater displeasure and lower life satisfaction. Psychological inflexibility components explained between 40 and 80% of the total effect of valuing happiness on our outcome variables. Our findings highlight the need for further research on the benefits of hedonic vs. values-based approaches to happiness. (shrink)

The literature on masculinity lacks thorough and sustained in situ examinations of how diverse boys employ their bodies to construct masculine identities during pubescence. To address this gap, the present article examines how a group of 10 sixth-grade Latino boys, who publicly acknowledged that they were experiencing puberty, employed their bodies at school to construct their masculine identities. The data suggest that among the boys, puberty was a social accomplishment connected to masculine enactments informed by the dominant gendered expectations of (...) peers at school and in their neighborhoods, the hegemonic masculine practices espoused by commercial hip hop rappers, and the dominant gender orders in the U.S and both Dominican and Puerto Rican societies. With physical displays of corporeal strength and tolerance for pain, the boys sought to signal that they were entering adulthood and preparing their bodies for a social world wherein physical confrontations between males were commonplace. The findings contribute to our understanding of how second-generation children who reside in low-income, working-class neighborhoods and have social ties to their nations of origin and their respective cultures construct masculinities in the United States. The article concludes with a call for longitudinal ethnographic studies examining how boys from various social backgrounds construct masculine identities during their pubescent development. (shrink)

Así, la incorporación de los estudios migratorios desde la perspectiva de las disciplinas dedicadas al análisis del gobierno y la política es una de las novedades más interesantes en el reciente panorama teórico de las migraciones. El objetivo (...) de este artículo es detenerse en algunos de los más significativos efectos de la inmigración en la esfera política de las sociedades de acogida a partir de una premisa de partida: las migraciones internacionales han difuminado tres tipos de “fronteras” políticas profundamente interrelacionadas en las sociedades modernas. En primer lugar, los límites físicos, territoriales del Estado; en segundo lugar, el perímetro de la ciudadanía y de la pertenencia definida por la asignación de derechos de naturaleza liberal y, en tercer lugar, el contorno de las comunidades nacionales en términos de identificación o afiliación cultural. This paper aims to analyze Jürgen Habermas’s critique of liberal eugenics and why it should be stopped. For this purpose, the concept of liberal eugenics, its features and goals, postmetaphysics in Habermas’s philosophy, will be exposed, as well as the notions of Körper and Leib, which are three key elements that the philosopher presents to articulate his critique. Next, the importance of the naturalness of birth and reciprocal relations between individuals, and how they can be affected by genetic modifications, will (...) be explored to finally expose the measurements that Habermas proposes against the effects and consequences of genetic engineering. This article is concerned with Extreme Case Formulations in multiple-party TV programmes in two different languages: Spanish and English. I examine the role of ECFs in Spanish pre-electoral debates and in English panel interviews. English data is 77 minutes and 58 seconds long and comprises nine different panel interviews of political, socio-political and social issues and Spanish data is 78 minutes long and includes four political pre-electoral debates. The results will disclose that the number of ECFs found in the Spanish (...) and in the English corpora differs considerably. And in relation to the type of recording, the data will reveal that interviewers and interviewees deployed many more ECFs in political recordings than in socio-political or social recordings ; and politicians used more ECFs than any other type of interviewees. Desde una hermenéutica discursiva y práxica, este artículo profundiza y madura teóricamente unas breves reflexiones epistémicas e históricas acerca de la problemática de la identidad plural en el pensamiento latinoamericano de estas últimas décadas. En un marco dominado por el giro “post” que caracterizan las ciencias sociales, se prosigue una línea de investigación que recupera importantes categorías y distinciones -brotadas en teorías de pensadores latinoamericanos-, para demostrar la ambigüedad socio-política del actual giro plural e intercultural de la identidad. Criticando debilidades (...) de ideas de algunos autores, se reconstruye una tensión entre contextualidad y universalidad que presupone topoi o lugares intra-latinoamericanos de enunciación, que van más allá de los tópicos diluidos de un cierto pensar postmodernista ligado mucho más a los contextos europeos y norteamericanos. A partir de ahí se descubren unos tópicos principales para renovar una interpretación intercultural del carácter propiamente latinoamericano de la identidad cultural. (shrink)

Salas“For he doth not feign, that rehearseth probabilities as bare conjectures....”Sir Walter Ralegh, The History of the WorldThe Secret HistoryIn 1603 Sir Walter Ralegh was judged guilty of treason and imprisoned in the Tower of London to await execution. The wait was a long one —execution did not take place until 1618—giving this artful courtier, warrior, poet, and poseur time to script (...) new roles for himself. The most memorable of these was historian, and the stage on which he performed was the entire world. Universal history had been a time-honored genre in England, but never had there been so remarkable a performance by a native son as Ralegh’s The History of the World (1614). In five books Ralegh offered to king and country his interpretation of events from Creation to 168 bc. Book V, last and lengthiest of the entire work, deals in large part with the struggle between Rome and Carthage. The story of that struggle is Ralegh’s most mature historical writing and the most revealing of himself, for when he gave up his plan to carry his history into modern times, the Punic Wars became the context for things about the present that he was loath to leave unsaid.Despite its length (about a million words) and premature ending, the History was an enormous success with a public eager to possess the meaning of it all. Oliver Cromwell particularly liked the way it followed “the strange windings and turnings of Providence”; 1 no doubt he found Ralegh’s emphasis upon the Providential control of events reassuring. For Ralegh claimed to show how “kings and kingdoms have flourished and fallen, and for what virtue and piety God made prosperous, and for what vice and deformity he made wretched both the one and the other.” 2 In fact what Ralegh showcased [End Page 195] were the acts of a vengeful, Old Testament God more concerned with punishing monarchical sins than with making monarchs prosperous, and the History was temporarily suppressed by James for being “too saucy in censoring princes.” 3If the king did not like what he saw in the History, the king’s critics did; and Ralegh, never a friend to Puritan or republican in his lifetime, became a hero to both as a pious author and victim of Stuart tyranny. Those sympathetic to the Stuarts, like Alexander Ross, Chaplain to Charles I, saw Ralegh rather differently; but the popularity of the man and his History could not be denied. Ross himself profited from that popularity by doing both an abridgment and a continuation of the History as well as Som Animadversions and Observations upon Sir Walter Raleigh’s Historie of the World. Wherein his mistakes are noted, and som doubtful passages cleered (1653). Many of these animadversions were directed at Ralegh’s treatment of the Punic Wars. Ross recognized that “mistakes” and “doubtful passages” there formed a pattern: “Sir Walter cannot look upon the Roman Glorie with but a squint eye”(8), he complained. But did he also recognize the reason for that squint eye, that Ralegh kept one eye on the past and the other on the present? That many of those “doubtful passages” were in fact strategic elements in a campaign (based on parallels) against Rome, against James, and against James’s ministry? Had this been obvious to Ross, he still would not have said so. Writing under Cromwell, he could no more afford to complain explicitly about abuse of James than Ralegh, writing under James, could afford to make the abuse explicit.Parallels—implicit or imagined—are part and parcel of Ralegh’s providentialism. In brief: God controls events, God does not change, events do not change. In this paper I discuss Albert the Great’s notion of univocal analogy, which he raised in his Commentary on Pseudo-Dionysius’s De divinis nominibus. While other scholars such as Francis Ruello and Alain de Libera have addressed “analogy” as it pertains to Albert, I intend to treat the “univocal” aspect of “univocal analogy” so as to explain (1) how it informs Albert’s teaching on analogy, and (2) how it remains opposed to any pantheistic reduction of God to creature. While my own (...) account remains close to that of Ruello and De Libera, I hope to show how primacy is to be accorded to univocity in such a manner that, in actual reality, for Albert, it is analogy that qualifies univocity rather than vice versa. Among the main assumptions of the well-known principle-based method in bioethics, the ideal of consensus assumes central importance. Indeed, by proposing this method, Beauchamp and Childress offer a base for a practical agreement that can be reached starting from different moral perspectives: they defend the universality of the principles shared by the common-morality theories. The ideal of consensus based on the universal acceptability of the principles is criticized by a large number of authors, communitarians and feminists. They attack the notion (...) of universality in different ways: universal principles cannot yield any practical solution to ethical problems. The feminists in particular emphasize the relational, emotional involvement, and also the particular context ofeach situation, as central elements of any practical decision, rather than the cold detachment of the conformity to principles and norms. This essay considers Edith Stein’s account of “essential being” and finds therein a point of continuity with medieval metaphysics. Scholarly attention has already been given to this feature of Stein’s metaphysics; it has been argued that “essential being,” while serving as a crucial point of distinction between Stein andThomas Aquinas’s own metaphysics, functions as a point of similarity between Stein and Duns Scotus. However, I argue that, while there are certainly manypoints of congruence between Stein and Scotus on the topic (...) of essential being, the position that Stein advances comes much closer to Henry of Ghent’s doctrineof esse essentiae. Finally, I show that the consequence of her adopting a position so similar to Henry of Ghent is that it opens Stein to a number of criticisms raised by Scotus himself against esse essentiae. Der Grund liegt in der allgemeinen Schwierigkeit, die allen, Menschen vertraute Erkenntnistätigkeit zu analysieren. Wenn es schon schwierig ist, unsere Erkenntnis der erfahrbaren Wirklichkeit zu analysieren, urn so mehr ist dies der Fall, wenn es um die Erkenntnis eines höchsten Wesens jenseits unserer Erfahrung geht. Im Artikel wird deshalb zuerst unsere Erkenntnis der Welt untersucht. Das Resultat ist folgendes: Die menschliche Erkenntnis besteht in einer Struktur verschiedener Erkenntnisakte, deren jeder ein eigenes Objekt hat und gemäβ Normen stattfindet, die unserem Erkenntnisstreben innewohnen. Diese Akte verteilen sich auf drei Ebenen. 1) In der Erfahrung erkennen wir ein Objekt als bloβ gegeben, als "Datum". 2) Mit der Einsicht erfassen wir in den Daten ein Intelligibles. Infolgedessen driicken wir das erkannte Intellibible in einem Begriff aus, mit dem wir das Objekt denken. 3) Mit dem Urteil bejahen wir absolut das gegebene und verstandene Objekt und damit erkennen wir es als ein Seiendes. Damit haben wir eine Wirklichkeit der Welt erkannt, aber nieht erklart, warum sie existiert. Die Frage nach der Existenz fuhrt schlieβlich zur Erkenntnis eines absolut transzendenten Wesens, das als ein unbegrenztes Intelligibles imstande ist, die eigene Existenz sowie die Existenz der Welt zu erklären.
